Terms of Use

By accessing or otherwise using this site, you agree to be bound by the agreement in these Terms of Use. Please read these terms of use carefully.

The first service (hereinafter referred to as RockBang) regarding the use of TradeInsight-related services between you and RockBang (Xiamen) Network Technology Co., Ltd. "TradeInsight" refers to the software products of RockBang (Xiamen) Network Technology Co., Ltd. "User" means the user of the TradeInsight related services, more commonly referred to as "you" in these Terms.

2. You must be at least 18 years old to use the Site and/or other Services. By using the Services, you represent and warrant that you meet these requirements.

These Terms include separate terms and conditions for your use of the TradeInsight Services, which may include separate terms and conditions, and related business rules (collectively, the "Separate Terms"). These Terms shall be an integral part of these Terms once they are officially published and you shall comply with them. Your acceptance of any of the aforementioned business rules and separate terms and conditions shall be deemed to be your acceptance of these Terms of Use in its entirety.

Content of Technical Services Performed

1. The specific content of the services you purchase is subject to the description in this Agreement. TradeInsight will charge extra for services beyond the selected plan.

2. The validity of the service is based on the time specified in the service plan you have selected.

Software Use

1. Registration: To use many aspects of the Services, you must first complete the registration process through the Website. Specific rules regarding your use of your account include a valid account name and password, a real email address, and valid cell phone contact information. You agree to: (1) as part of the registration process ("Registration Data"); (2) maintain the security of your password; (3) maintain and promptly update the Registration Data and any other information provided to Company and keep it accurate, current and complete; (4) you are responsible for maintaining the security of your account and protecting your password; and (5) you will be fully responsible for using your account or password for You are solely responsible for any activity or transaction conducted using your account or password. You must immediately notify the Company of any breach of security or unauthorized use of your account. Although Company is not responsible for any damages resulting from any unauthorized use of your account, you may be liable for damages caused to the Company or others as a result of such unauthorized use.

2. Access to the Services: Subject to these Terms and Conditions and the Registration Criteria, the Company hereby grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right (1) to access and use the Services, including, without limitation, the Platform, the Website, the API and related documentation and software, solely in conjunction with your internal activities related to or applicable to the Services; (2) to access and use any data or reports provided or made available by Company to you any data or reports as part of your access to and use of the Services, solely in connection with your use of the Services.

4. Duration: For the TradeInsight Platform Services, you will be able to access www.tradeInsight.com according to the Service Plan (as defined below) to which you subscribe. For all other Services, you will be able to access such Services for the duration of your use of such Services or as otherwise communicated by the Company.

5. Users: Each User Account is valid for only one User and may not be shared by multiple Users at the same time or in any other manner. You may acquire and/or reassign user accounts to new users within your organization. Users of the Services are limited to your employees or their suppliers.

6. Restrictions on Use: Modification, reverse engineering, reverse compilation, disassembly, or creation of derivative works incorporating the Services or any part or component thereof is expressly prohibited. Except as expressly authorized by these Terms and Conditions, you and your users may not split, sublicense, transfer, assign, display, distribute, rent, resell or lease the Services or any part or component thereof to any third party. In addition, you may not (1) use the Services to store or transmit any viruses, software routines or other code designed to allow anyone to access, disable, delete or otherwise damage software, hardware or data in an unauthorized manner, or perform any other harmful acts; (2) build competitive products or services, or copy any features or functionality of the Services (including, without limitation, the appearance of the Services); ( 3) interfere with or disrupt the integrity or performance of the Services; (4) disclose any performance information or analysis related to the Services to any third party; (5) remove, alter or obscure any proprietary notices, including copyright notices, in or on the Services; (6) use the Services or any of their products for any unlawful or unauthorized purpose or in a manner that violates any law or regulation under your jurisdiction; ( (7) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code, object code or infrastructure, ideas or algorithms that comprise the Services or any software, documentation or data associated with the Services, except to the limited extent that such restrictions are prohibited by applicable law; (8) monitor the availability, performance or functionality of the Services, or for any other benchmarking or competitive purposes; (9) cause or permit any third party to do any of the foregoing.

7. Right of Termination: Company reserves the right to deny or revoke access to the Services or any part thereof, or otherwise terminate your access to the Services, at any time, in its sole discretion, with or without cause, without notice to you subject to these Terms and Conditions.

8. Third Party Providers: You understand that Company uses third-party providers and hosting service providers or partners to provide the necessary hardware, software, network, storage, and related technology required to provide the Services, and you agree that Company has no responsibility or liability for the acts or omissions of such third party providers or hosting service providers or partners.

9. Electronic Communications: By using the Services, you agree to receive electronic communications from Company for all purposes, including, but not limited to, logistical and marketing purposes.

Protection of Users' Personal Information

The protection of users' personal information is a basic principle of TradeInsight, which will collect, use and store your personal information by the provisions of these Terms.

2. You may need to fill in some necessary information in the process of registering an account or using this service. If there are special provisions in national laws and regulations, you need to fill in the real identity information. If you fill in incomplete information, you will not be able to use the service or be restricted in the process of use.

3. In general, you can browse and modify the information you submit at any time, but for security and identification (such as number complaint service), you may not be able to modify the initial registration information and other verification information provided during registration.

4. TradeInsight will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use, or disclosure.

5. TradeInsight will not transfer or disclose your personal information to any non-affiliated third party without your authorization unless required by relevant laws and regulations or by courts or government agencies.

6. If you are a minor under the age of 18, you should obtain the prior written consent of your parent or legal guardian ("Guardian") before using TradeInsight's services.

Confidentiality Provisions

1. Subject to the express permission of these Terms, the Parties will protect each other's Confidential Information from unauthorized use, access, or disclosure in the same manner as each protects its Confidential Information, but not less than reasonable care. Except as otherwise expressly permitted herein, TradeInsight, User, and their respective affiliates may use the other party's Confidential Information only to exercise their respective rights and perform their respective obligations under these Terms and only to their respective employees, agents, and representatives, their respective employees and their respective employees, agents and representatives, who need to know such information to perform their respective duties.

2. You agree that TradeInsight, its affiliates, and their respective employees, agents, and representatives have the right to access your account and to use, modify, transfer, copy, display, and disclose data to the extent necessary to provide the Services, including, without limitation, restrictions, in response to your support requests. You agree that only to the extent necessary to provide the Services, TradeInsight shall be authorized to (1) permit the use, modification, copying, and (2) disclosure of data (including confidential information) to authorized sub-processors, authorized carriers, end users, TradeInsight customers, transportation providers, third-party service providers and their employees, agents, and representatives.

3. TradeInsight will maintain commercially reasonable administrative, physical and technical safeguards to protect the security, confidentiality, and integrity of your data.

4. TradeInsight may also disclose confidential information and information about accounts, data, and users to (1) comply with applicable laws and regulations; (2) respond to lawful requests, legal processes, court/other legal authority orders, and/or subpoenas; (3) protect TradeInsight's rights or property, including enforcing these Terms or other policies related to the Services policies; and/or (4) protection of personal safety.

5. The confidentiality obligations of the parties shall not be discharged by the termination of this Agreement.

Provide services according to existing capacity

 Trojan horses, hacker attacks, system instability, third-party service defects, government actions, and other possible causes of service interruption, data loss, and other losses and risks.

Fee-based Services

1. Some of TradeInsight's services are provided on a fee-based basis, and if you use the fee-based services, please comply with the relevant terms and conditions.

2. TradeInsight may modify and change the rates and methods of chargeable services according to actual needs, and TradeInsight may also start charging for some free services. TradeInsight will notify or announce on the corresponding service pages before the aforementioned modifications, changes, or commencement of charges. If you do not agree with the aforementioned modifications, changes, or paid content, you should stop using the service.

Intellectual Property Rights

1. The intellectual property rights of the contents provided by TradeInsight in the Service (including but not limited to web pages, text, pictures, audio, video, graphics, etc.) belong to TradeInsight, and the intellectual property rights of the contents generated by the User in the use of the Service belong to the User or the relevant right holder.

Unless otherwise specifically stated, the copyrights, patents, and other intellectual property rights of the software relied upon by TradeInsight in providing the Service are owned by TradeInsight.

3. TradeInsight owns the copyrights or trademarks of the trademarks used by TradeInsight in the Service.

4. The intellectual property rights of the above and any other contents contained in the Service are protected by law, and no one is allowed to use or create related derivative works in any form without the written permission of TradeInsight, the User, or the relevant right holder.

Liability for breach of contract

1. If you cannot use the corresponding services due to TradeInsight's reasons, TradeInsight shall compensate you for the economic losses caused to you in addition to compensating you for the service period equal to the interruption of the service.

2. If you violate your obligations under this Agreement and cause losses to you, you shall compensate TradeInsight for the actual losses suffered as a result, including but not limited to damage to TradeInsight's system, and TradeInsight shall have the right to suspend the provision of services for you until the problem is resolved as provided in this Agreement, and the resulting losses You will be responsible for any resulting damages.

Force majeure and other exemptions

1. Given the special nature of computers and the Internet, events caused by hackers, viruses, technical or policy adjustments of telecommunications departments, or short-time interruption of TradeInsight's services for server configuration and maintenance, or the blockage of the Internet pathway causing your services to be affected, are not a breach of contract by TradeInsight. TradeInsight shall not be liable.

2. Force majeure refers to objective events that cannot be foreseen, overcome, and avoided and have a significant impact on one or both parties, including but not limited to changes in applicable laws or regulations in effect, natural disasters such as floods, earthquakes, plague epidemics and storms, and social events such as wars, unrest, governmental actions, etc. In the event of the above, TradeInsight will endeavor to cooperate with the relevant units in the first instance and make timely repairs, but TradeInsight is exempt from liability for any losses caused to you as a result to the extent permitted by law.

3. To the extent permitted by law, TradeInsight shall not be liable for any interruption or disruption of services caused by: (1) damage by computer viruses, Trojan horses or other malicious programs, hacker attacks; (2) failure of the user or TradeInsight's computer software, systems, hardware and communication lines; (3) improper operation by the user; (4) the user through (4) use of the Service by means other than those authorized by TradeInsight; (5) other circumstances beyond the control or reasonably foreseeable.

4. In the performance of this Agreement, TradeInsight shall not be liable for losses caused to you or other parties due to the fault or delay of third parties. TradeInsight shall not be liable for losses of third parties who indirectly receive TradeInsight services through you.

5. Due to incompatibility between TradeInsight and the specific software and hardware used by you (e.g., system. TradeInsight is not responsible for, and cannot guarantee that the above will not occur if incompatibilities or errors are reported on your cell phone or computer.

6. Since TradeInsight services are standardized products, TradeInsight cannot guarantee that the more extensive services will fully meet your management requirements and processes, and TradeInsight cannot guarantee that the software service system will be specifically modified to meet your requirements.

Cancellation of the agreement

  This Agreement is terminated under the following circumstances.

1. The parties terminate this Agreement by consensus

2. The term of this Agreement expires and is not renewed by both parties.

3. The disappearance of the main qualification of one party, such as being withdrawn or entering bankruptcy or liquidation procedures, the other party has the right to unilaterally terminate the Agreement, except for reorganization, name change, or, separation or merger with a third party

4. If one party fails to perform or violates its obligations under this Agreement and does not perform its obligations or take remedial measures within a certain period given by the other party, the expected benefits of the other party under this Agreement cannot be realized or the continued performance of the Agreement is unnecessary, the other party has the right to unilaterally terminate the Agreement.

5. If one party adopts fraud, coercion, or violence in the conclusion or performance of the agreement, the other party may unilaterally terminate this agreement and has the right to demand compensation for damages from the other party.

6. Due to force majeure or unforeseen events that agree can not continue to perform or continued performance not necessary, both parties may request the termination of the agreement.

7. After the termination of the Agreement, the rights, and obligations of both parties under the Agreement shall be terminated, but the obligations that one party should have performed before the termination of the Agreement shall still be performed.

  Entry into force and changes to the terms and conditions

1. Your use of TradeInsight's services shall be deemed that you have read these Terms and Conditions and accept the binding of these Terms.

2.TradeInsight reserves the right to modify the content of these Terms of Use when necessary. You can check the latest version of the Terms of Use on the relevant service page.

3. If you continue to use the software or services provided by TradeInsight after the content of these Terms has been changed, you are deemed to have accepted the modified Terms. If you do not accept the revised Terms and Conditions, you should stop using the software or services provided by TradeInsight.

Change, interruption, and termination of services

1  . TradeInsight may make changes to the content of the Services, and may also interrupt, suspend or terminate the Services.

2. You understand and agree that TradeInsight has the right to determine its business strategies. In the event of a merger, demerger, acquisition, or transfer of assets of TradeInsight, it may transfer the relevant assets under the Services to a third party; TradeInsight may also transfer some or all of the Services under these Terms to a third party for operation or performance upon unilateral notice to you. The specific subject of the transfer is subject to TradeInsight's notification.

3. TradeInsight shall have the right to interrupt or terminate the services provided to you without notice in the event of any of the following circumstances: (1) You are required by law to submit truthful information, and the personal information provided by you is untrue or inconsistent with the information at the time of registration and fails to provide reasonable proof; (2) You violate the relevant laws and regulations or the agreement of these Terms; (3) By the law or the requirements of the competent authorities; (4) For security reasons or other necessary circumstances.

4. TradeInsight has the right to charge fees by the terms of the Agreement. If you do not pay in full and on time, TradeInsight has the right to interrupt, suspend or terminate the provision of services.

5. You are responsible for backing up your data stored in the Service. If your service is terminated, TradeInsight may permanently delete your data from the server, except as otherwise provided by law or regulation. TradeInsight is not obligated to return your data to you after the termination of the Service.

  Applicable Law

This Agreement and the rights and obligations of the parties hereto shall be governed by and construed by the laws of the People's Republic of China. Any dispute arising from the performance of this Agreement shall be settled through friendly consultation between the parties. If the negotiation fails, any litigation may be filed in the People's Court where this Agreement is signed.
